In order to protect California workers from exploitation by employers, the California legislature has created a regulatory scheme to ensure that workers are justly compensated. For example, California employers are required to pay their workers overtime.
When does Overtime Apply?
A California employee must be compensated at time and a half (or 1½ times his or her regular rate of pay) if the employee works:
- more than 8 hours a day
- more than 40 hours a week
- seven consecutive days in a workweek (all time worked on the seventh day is overtime, except when double-time applies.)
A California employee must be compensated at twice the regular rate of pay if the employee works:
- in excess of 12 hours in one day
- more than 8 hours on the seventh consecutive day of work in a workweek
Typically, a California employer facing a lawsuit for unpaid overtime compensation will allege that the plaintiff employee is “exempt” from overtime pay on account of his job position. However, these exemptions are limited to professional positions, administrative positions, managerial positions, industry-specific positions and certain union employees.
